UC, café battle over Bearcat name

The university sued the café and its current owner, Tony Hamburg, last month for violating a trademark on a name the school claims it has used since at least 1919.

Long story short, UC is suing Baba Budan's Bearcat cafe for using the word "bearcat" even though the cafe has been using it longer than the school has had it trademarked. The way the school is getting to sue is since the cafe had to reapply after being forced out of their old location due to emminant domain and had to refile paperwork. Since the paperwork was dated after the trademark, the school now has an open window to go in and rape everyone up... children, wives, husbands, errbody!

I understand that the school is having a hard time financially (those multi-million dollar donations can only go so far to keep the lights on), but is sueing a small local business the way to go? It is sad we live in an age where common sense rarely prevails.
